IMPLEMENTASI AKAD GADAI SAWAH PERSPEKTIF EKONOMI SYARIAH (Studi Desa Merbau Mataram Kabupaten Lampung Selatan)
Abstract
The implementation of pawning is a tradition that has been rooted in society, the need is urgent and there are no other skills that can be done, then pawning becomes a solution to fulfill one's desires. Usually the farmers or the people of Merbau Village, Mataram, pawn their fields because of urgent needs and need immediate funds. This study aims to further examine whether the practice of pawning rice fields that has been carried out by the people of Merbau Village, Mataram, is in accordance with the sharia perspective.
The results showed that the Pawning System for Pawning Fields in Merbau Village, Mataram, in general, pawnbrokers (rahin) came to the recipient of the pawn (murtahin) to borrow some money to meet their needs with the rice fields as collateral. The time to return the loan money (debt) is not determined until Rahin is able to pay the debt. As for the deadline for repayment, it is usually determined in an annual form and without a certain time limit. The right to control or use the rice fields is in the hands of the murtahin until the debt is paid off. if the implementation of the contract has met the terms and conditions of the pledge, as for the taking of the benefits of the collateral which is fully controlled by the recipient of the pawn (murtahin) which occurred in Merbau Village, Mataram, it is not valid according to Sharia Economics
